Payment, Shipping & Returns Policy
Shipping Policy.
The Materials will be shipped by FedEx, DHL, UPS or a major courier service in accordance with Product Specification. Please note that shipping and handling fees will be added in your final invoice depending on your location, type of Product, size/weight of the package, etc. We ship all Frozen Bio-specimen’s by Cryoport Dry Shipper or FedEx Priority Overnight Shipping in dry ice.
Return of Materials
To reject any Materials, please provide Bay Biosciences LLC., with written or electronic notice of your intent to reject within seven (7) business days of your receipt of the applicable Materials.
Please include an indication of the basis for such rejection with the above required notice to Bay Bioscience LLC.
If Bay Biosciences does not receive your notice within the applicable time limit stated above, Bay Biosciences LLC. will deem the Materials to have been accepted.
For any Materials properly rejected in accordance with this policy, the customer shall be entitled to return the materials, in reasonable good condition at your expense, for replacement by Bay Biosciences within thirty (30) days post receipt of shipment.
Bay Biosciences reserves the right to refuse the return of any materials that have been substantially altered in a manner that affects the materials size, format, weight or quality. Bay Biosciences also reserves the right to reject replacement when the determined issue is due to the client.
Custom Orders and prospective customized collections; All custom orders are final, and non-returnable.
Non-Defective Product Return. Customers may return most non-defective items (subject to manufacturer’s return policy) to us within 30 days of invoice, either for credit or exchange. An automatic 15% restocking fee applies to all such returns. All shipping, packaging, handling and related charges are not refundable.
Returns will be made as refund minus shipping and handling cost, and 15% (of the final price) restocking fee.
This Return Policy is applicable to all acquisitions of Materials from Bay Biosciences. This Return Policy may be modified only by written agreement. This Return Policy may be subject to agreements entered into by Bay Biosciences and its clients. Bay Biosciences reserves the right to change the return/exchange policy without notification.
Notice of Rejection.
The Materials shall be provided in accordance with the Order Specifications.
To reject any Materials, please provide Bay Biosciences LLC., with written or electronic notice of your intent to reject within Seven (7) business days of your receipt of the applicable Materials.
Please include an indication of the basis for such rejection with the above required notice to Bay Bioscience LLC.
Client shall have seven (7) days after receipt of any Materials to provide written notice to Bay Biosciences LLC. of any failure of the Materials to meet the Specifications (the “Rejection Notice”). The Rejection Notice shall include (i) a description of the Materials and the specific Specimens being rejected; (ii) a statement of the reason(s) for such rejection; and (iii) a photo of the gels, images or other relevant experimental data; and (iv) certification from customer that the materials were prepared, handled and maintained by Customer in accordance with the instructions for handling provided by Bay Biosciences LLC.
If Bay Biosciences LLC., does not receive your notice within the applicable time limit stated above, Bay Biosciences LLC. will deem the Materials to have been accepted.
Replacement or Refund.
If Customer rejects any Specimens and this rejection is not a result of mishandling by Customer, Bay Biosciences LLC., shall replace the defective Specimens within reasonable time, not to exceeding ninety (90) days. At Bay Biosciences LLC., request, Customer shall ship the defective Specimens to Bay Biosciences LLC., and Bay Biosciences LLC., shall have a reasonable opportunity, not to exceed fifteen (15) business days from receipt of the returned Specimens, to inspect, test, or analyze any allegedly defective Specimens. Any inspection, testing and analysis by Bay Biosciences LLC. shall not eliminate or delay Bay Biosiences LLC., obligation to replace defective Specimens with Order Specifications-conforming Specimens. If Bay Biosciences LLC., is unable to replace defective specimens, Customer shall be entitled to cancel such Project and obtain a full refund or credit any payment made by Customer for such rejected Specimens within 30 days. If shipment of the rejected Specimens is not requested by Bay Biosciences LLC., within 30 days upon receiving a Rejection Notice, Customer shall dispose of such Specimens in accordance with all applicable laws, rules and regulations regarding disposal of the Materials.
For any Materials properly rejected in accordance with this policy, the customer shall be entitled to return the materials, in reasonable good condition, at your expense, for replacement by Bay Biosciences within ninety (90) days post receipt of shipment.
In case there is a problem with the preparation or fixation of the materials provided we do our best to work with the researcher to mutually resolve the issue. Customers may return defective items to us within 30 days of invoice, either for credit or exchange. An automatic 15% of the total value of the order or minimum $150 (whichever is higher) restocking fee applies to all such returns. All shipping, packaging, handling and related charges are not refundable.

Terms
Payment terms are net 30 days. Overdue amounts are subject to interest charges at 1.5% per month. We accept payment by check, wire transfers. We reserve the right to require prepayment. Shipments will not be made to customers with “Past Due” pending.
